Are You Sure That Land Is Not Already Acquired?


UNDERSTANDING LAND CLASSIFICATIONS 

Land can be classified as either free or acquired. A parcel of land is considered free if the government has not indicated any interest whatsoever in that land. Such land is safe to buy because the title on the land can be perfected without issues.  A free land has title such as Cof O, Governor’s consent or Gazette.
There are two types of acquisition: 
1. Committed Acquisition 
2. Global / General Acquisition. 

Committed Acquisition 

A parcel of land is said to be committed when the government statutorily acquired such lands for public interest and already has plans for its use. Such use may include drainage, roads, rails, Government estates and any other infrastructure that would enhance the quality of life of its citizens. Such land are rarely released or given up by the government and can never be available for use by individuals.
 It will therefore be impossible for anyone  to perfect  land title  for such lands and occupier  will  only be occupying the land until the government comes to take over.

Global or General Acquisition 

Global Acquisition is a land acquired by the Government for its own specific use and there are plans for these lands in the nearest future depending on what the Government intends to do with the land.
Lands that are under “general acquisition” or “global acquisition” can later be confirmed “free” at the government’s discretion or “committed” as the case may be.
Individuals who have bought land under government are given the opportunity to process their land papers and obtain layout plans as long is outside the committed areas and such structures does not violate the states physical and town planning codes.
The process whereby illegal owners of lands in areas under Government acquisition that are not committed lands are given the opportunity to obtain a legal title to the land encroached or trespassed upon from the State Government is known as Land Regularization and this is done at Land Registry at Alausa.
